Functions of NLUPC

1.1 Background
The National Land use Planning Commission (NLUPC) was established by Act of Parliament No. 3 of 1984 and later repealed by Act No.6 of 2007. The establishment of the Commission was considered necessary after realising that the policy, legal and the Institutional set up had not been effective enough in coordinating various land use related activities and programmes undertaken by different sectoral organization in the Government, Private sector and Non Governmental Organisations.

The Commission was established so as to harmonize and co-ordinate all land use related policies and legislation, to promote effective management and enhancement of land quality with the aim of ensuring sustainable utilization of land, so that it can provide optimal production to enhance socio-economic development and maintenance of land quality for long term productivity.

The Commission is empowered by section 10 of Act No.6 of 2007, may determine such number of persons to serve as officers of the Commission, a decision was made in the Second Commission Meeting held on 28th August 2009 to re-establish the Finance and Administration Division and the Planning and Internal Auditor Units to be under the Director General. This decision was made according to the advice from the National Institute of Productivity which was commissioned to study the organisation structure, salary structure, manning levels and incentive packages. Also expert advice was sought from NEMC to improve the organisation structure while an experienced Human Resources Development Officer from the Ministry of Lands, Housing and Human Settlements Development improved the Scheme of Service in line with professional scheme of services in the Government of Tanzania.

Other expert advice was sort from Engineering and Registration Board, National Board of Accountants and Auditors, Tanzania Commission for Universities, Fair Competition Commission, Health Environment Limited and Fan Fare ‘T’ Traders. In short they said that Finance and Administration is not a core business of the Commission, so it was categorically advised that the division should break in two units to be directly supervised by the Director General.

On the basis of the existing requirements and according to expert advices, the new structure of the Commission with four Divisions is as follows:-
1. One Director General
2. Four Directors
3. Three Units of Planning, Finance and Internal Auditor
4. Fifteen Sections

1.2 The Mandate
The mandate of the Commission is to facilitate the effective management of land and human settlements development services for the betterment of social and economic well-being of the Tanzanian society.

1.3 The Functions
Functions of the Commission shall be to:-
i. coordinate, advice and inspect all sectors on collective standards and to advise the Minister to make the agreed standards;

ii. provide assistance to all planning authorities and prepare land use plans, monitor their implementation and from time to time evaluate them;

iii. co-ordinate the activities of all bodies concerned with land use planning matters and serve as a channel of communication between such institutions and the Government;

iv. design and disseminate programs that will effectively protect and enhance the quality of land and better land use planning;

v. stimulate public and private participation in activities related to land use planning for rational and beneficial use of land;

vi. foster co-operation between the Government, local government authorities and other institutions engaged in land use planning;

vii. promote the advancement of scientific knowledge in land use matters and encourage the development of technology directed at the prevention or reduction of adverse effects on land;

viii. specify standards, norms and criteria for the protection of beneficial uses and the maintenance of the quality of land;

ix. undertake and co-ordinate research, investigation and surveys relating to land use planning and collect, collate and create a national data bank to disseminate information about the findings of such research, investigation or survey;

x. establish and operate a system of documentation and dissemination of information relating to land use planning;

xi. in consultation with sector Ministries, examine existing laws and advise the Government on legislative and other measures for the management of land use planning and recommend their implementation;

xii. establish and maintain liaison with other countries and international organisations, with respect to issues and matters relating to land use planning;

xiii. undertake, in co-operation with relevant agencies, programmes intended to enhance land use planning education, and public awareness about the need for sound land management and for enlisting public support and encouraging the effort made by other entities in that regard;

xiv. undertake and promote educational programmes in land use planning for the purpose of educating the public on proper land use planning and the role of the public in its protection, use and improvement;

xv. ensure compliance with the approved land use plans; and

xvi. Perform such other functions as may be assigned to it under this Act.


Majukumu ya Tume ya Taifa ya Mipango ya Matumizi ya Ardhi

1) Kuratibu, kushauri na kukagua sekta zote kuhusu viwango vya pamoja na kumshauri Waziri kuweka viwango vilivyokubalika.

2) Kutoa msaada kwenye mamlaka zote za upangaji wa matumizi ya ardhi na kuandaa mipango ya matumizi ya ardhi, kuratibu utekelezaji wake na, kuifanyia tathmini kila wakati.

3) Kuratibu shughuli za vyombo vyote vinavyohusika na mambo ya upangaji wa matumizi ya ardhi na kutumika kama njia ya mawasiliano kati ya taasisi hizo na Serikali.

4) Kubuni na kuhakikisha uendelezaji wa progamu ambazo zitalinda na kuiniar-isha kwa ukamilifu ubora wa ardhi na upangaji wa matumizi ya ardhi

5) Kuhamasisha ushiriki wa umma na sekta binafsi katika shughuli zinazohusiana na upangaji wa matumizi ya ardhi kwa ajili ya matumizi ya ardhi yenye uwiano na manufaa.

6) Kuendeleza ushirikiano kati ya Serikali, mamlaka za serikali za mitaa na taasisi nyingine zinazojishughulisha na upan­gaji wa matumizi ya ardhi.

7) Kuhuisha maendeleo ya maarifa ya kisayansi katika mambo ya upangaji wa matumizi ya ardhi na kuhimiza maendeleo ya teknolojia yanayolenga kwenye uzuiaji au upunguzaji wa madhara makubwa katika ardhi.

8) Kuainisha viwango, desturi na vigezo kwa ajili ya ulinzi wa matumizi yenye manufaa na kudumisha ubora wa ardhi.

9) Kuendesha na kuratibu utafiti uchunguzi na upimaji wa ardhi unaohusiano na upangaji wa matumizi ya ardhi na kukusanya taarifa, kuzipanga kwa uta ratibu na kuanzisha benki ya taifa ya takwimu ya kueneza taarifa ya matokeo ya utafiti, uchunguzi au tathmin za ardhi.

10) Kuanzisha na kuendesha mfumo wa kumbukumbu na uenezaji wa taarifa inayohusiana na upangaji wa matumizi ya ardhi.

11) Kwa kushauriana na Wizara zozote za kisekta, kutathmini sheria zilizopo na kuishauri Serikali juu ya hatua za kisheria na nyinginezo kwa ajili ya upangaji wa matumizi ya ardhi na kupende keza utekelezaji wake.

12) Kuanzisha na kudumisha ushifikiano na nchi nyingine na mashirika ya kimataifa, kwa ajili ya masuala na mambo yanayohusiana na upangaji wa matumizi ya ardhi.

13) Kushirikiana na sekta binafsi, taasisi zisizo za kiserikali wakala wengineo kuandaa na kutekeleza programs zinazokusudia kuimarisha elimu ya upangaji wa matumizi ya ardhi, na mwamko wa umma kuhusu haja ya usimamizi bora wa matumizi ya ardhi na kwa ajili ya kushawishi umma kusaidia na kuhimiza jitihada zinazofanywa na vyombo vingine kwa ajili hiyo.

14) Kuendesha na kuunga mkono programu za mafunzo katika upangaji wa matumizi ya ardhi kwa ajili ya kuelimisha umma juu ya upangaji wa matumizi ya ardhi unaofaa na wajibu wa umma katika ulinzi, matumizi na uboreshaji wake.

15) Kuhakikisha na kuratibu utekelezaji wa mipango ya matumizi ya ardhi inayoidhinishwa

16) Kufanya shughuli nyingine kama itakavyoagizwa chini ya Sheria ya Mi­pango ya Matumizi ya Ardhi.
